In mediation, a neutral third party, the mediator, assists the parties and their attorneys in reaching an amicable resolution of their dispute without the necessity of a final trial or hearing before the court. In arbitration, the parties enter into an agreement to submit their disputes to an arbitrator who will substitute and serve as the judge in their case. Usually, this provides families with privacy that they would not receive at the court house and can often save valuable time and money by having the dispute resolved in a less formal manner.
